1. Australian Entrants: Premium carriers' SMS costs apply to enter. The maximum SMS cost from most mobile services is 55 cents (including GST). A return SMS will be sent to entrants to confirm that their entry has been successfully received. The cost of a 1900 call will not exceed $0.55 including GST. Mobile phones and payphones may attract a higher rate. Entrants will receive a confirmation voice message of their entry during the call.
2. Entries via SMS(AUS only) will only be accepted from mobile phones. Any form of automated entry using any other devices or software is invalid. Entries will only be valid when the SMS messages are paid for. If the Promoter (or any of its Suppliers) considers that there has been excessive use/manipulation of the entry process then that will be deemed to constitute manipulation (which will entitle the Promoter to exclude the relevant participant from the process).
3. The Promoter reserves the right to verify the validity of entries. The Promoter reserves the right to disqualify any entrant for tampering with the entry process or for submitting an entry which is not in accordance with these Terms and Conditions.
4. All entries become the property of the Promoter. Entries not completed in accordance with the Terms and Conditions, or received after the closing date will not be considered. Indecipherable or incomplete entries will be disregarded. The judge's decision in relation to any aspect of the competition is final and binding on every person who enters. No correspondence will be entered into.
5. Promotion commences 01/06/06 and finishes 12.00am (AEST) 28/02/07 and 2.00am (NZT). One in every ten SMS/1900 entrants will win a Kitten Handy Car Tool Kit value of approximately $25. Major Prize is $10,000 (AUD) cash. The draw for the major prize will take place at Level 27, Tower 2 Darling Park, 201 Sussex Street, Sydney 2000 on 07/03/07 at 10.00 am. Winners will be notified by phone and the names of winners will be published in The Australian newspaper and the New Zealand Herald on 14/03/07. The Judges' decision is final and no correspondence will be entered into. All SMS/1900/0800 prize winners will be contacted by the Promoter and the Promoter will record their address details so that the prize may be awarded. Total prize value is $85,000. The number of entries is unlimited, but only one minor prize will be awarded per person.
6. The Promoter is not responsible for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
7. The charges for all SMS/1900/0800 entry Services will appear on your next mobile phone bill. All queries relating to phone bills should be directed to your mobile or telephone carrier.
8. The Promoter collects entrants' personal information in order to conduct the promotion. If the information requested is not provided, the entrant may not participate in the promotion. By entering the promotion, unless otherwise advised, each entrant also agrees that the Promoter may use this information, or disclose it to other organisations that may use it, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the entrant. Entrants' personal information may be disclosed to State and Territory lottery departments and winners' names published as required under the relevant lottery legislation. A request to access, update or correct any information should be directed to the Promoter at their address set out below.
9. SMS is not a guaranteed delivery communication tool. The Promoter and the service provider cannot accept responsibility for any SMS messages not received, any SMS reply message or for any delay in the delivery of the SMS message due to technical disruptions, network congestion, network failures or for any other reason.
